WHAT IS NIS 2?
The NIS2 Directive is an updated version of the NIS Directive ( Network and Information Security ) which has been in force since 2016. The European Union's NIS2 directive on cybersecurity has been in force since the beginning of 2023 and aims to increase the resilience of companies and institutions and unify security in European cyberspace. Member states are obliged to adapt this directive into their legal system, here the new law is required to take effect on 18 October 2024 and will affect more than 6,000 companies in the Czech Republic compared to the original 450 or so.
WHY WOULD YOU WANT TO DEAL WITH THAT?
The primary role of the Directive is to encourage the entities concerned to implement preventive measures to ensure and strengthen cyber security, i.e. in particular to take appropriate and proportionate technical and organisational measures to manage the security risks faced by the networks and information systems used by these entities to provide their services.
The management of the organisations concerned is thus now obliged to approve and implement security measures. This obligation also includes the need for regular training for both senior management and rank-and-file employees.
The main duty of an organisation, if an incident occurs, is to manage the incident successfully. However, in addition to incident management, the NIS 2 Directive imposes an obligation on those concerned to report certain incidents to the competent authorities.
Failure to comply with NIS2 then carries the risk of financial penalties depending on the severity of the breach and other circumstances.
Such penalties can be up to €7 million or 1.4% of total worldwide annual turnover for significant entities and up to €10 million or 2% of total worldwide annual turnover for basic entities, whichever is higher.

The Cybersecurity Act based on NIS2 is not yet in force, so at the moment no one can say for sure that it will prepare you perfectly for NIS2. However, we can prepare everything according to the current legislation and then extend and supplement the technology when the new law comes into force.
NIS2 applies to a wide range of sectors and public administrations, generally all entities falling under Critical Infrastructure Level 1 with over 50 employees, e.g. healthcare, energy, etc.
There will be many obligations, but we will know their exact wording for sure when the new law on cybersecurity comes into force. For now, we know that all computer networks will have to be secured ‘from the outside’ with a quality firewall, and there will be a new obligation to comply with SLA (simplified readiness of the technician), to remove faults or unavailability of the service within a set period of time. In the strictest cases, the removal of the fault or the service is available for 24 hours, even on weekends and holidays.
If there is a service or system failure (incident), the Company is obliged to resolve it within the time specified by law and in the event of non-compliance with the terms of NIS2, you are exposed to the risk of a penalty under the law. In addition, some incidents have a notification obligation which will be specified in the law. Failure to comply with this condition again exposes you to the risk of a penalty under the Act.
